Accept the Terms and Conditions

Please read these Terms & Conditions carefully before accessing and using the services on the Joblink.vn recruitment website (hereinafter referred to as the “Joblink Website”) of the Company. By accessing and using the Joblink Website, you (hereinafter referred to as “you” or “Customer”, unless otherwise required in context) accept these Terms & Conditions and agree to be bound by the regulations governing the use of the Services on the Joblink Website. Joblink Services

Joblink.vn is a website on the Internet designed to allow users to post job advertisements and/or view jobs posted by other users, or interact with other users. Joblink.vn is owned and operated by the Company. The Joblink website contains and may contain information, news, opinions, text, graphics, links, electronic artwork, animations, sounds, videos, software, pictures, music, noises and other content and data (collectively referred to as “content”) formatted, organized and collected in various forms accessible to users, including directories, databases and areas on the Joblink.vn website that users can modify, such as posting job advertisements, uploading multimedia files, registering user profiles and creating self-notification profiles (“interactive areas”).

To fully utilize the services on the Joblink website, you need to register and create an account, providing Joblink with certain personal information, including but not limited to your email address, for communication between you and Joblink, as well as other users. By registering, you agree to receive notifications, emails, messages, calls, or other forms of communication about Joblink's products and services. While there may be legal limitations on this matter and other agreements between parties, you agree that such limitations will not apply. Whenever you no longer wish to receive these notifications and/or emails, or wish to change the information you wish to receive, please notify Joblink using the available functions on the Joblink website or in the email itself. Your personal information will be stored and processed securely in accordance with Joblink's Website Privacy Policy.

You may order services or products at the listed prices available on the Joblink website, and your order is subject to your acceptance of some or all of these terms and conditions of the Joblink website. This acceptance by the Joblink website is only legally binding once you have made payment or your payment information has been confirmed.

The company reserves the right to change the services, products, price lists, pricing methods, and other changes to the Joblink website from time to time without prior notice to users if deemed appropriate.

The Company reserves the right to refuse to provide services to individuals or organizations that, as stipulated by law or at the Company's sole discretion,:

  1. Having business activities in the same field or industry as the Company, including but not limited to, business activities providing employment services through websites, e-commerce applications selling goods and/or websites, applications providing e-commerce services (e-commerce trading platforms); and/or

  2. Operating and managing websites and applications related to recruitment and job services similar to the Company's website and application platforms for business and profit-making purposes; and/or

  3. The exploitation and use of information provided by the Company's services is not for the purpose of recruiting for that individual or organization; and/or

  4. Offer products and services that are competitive with Joblink's existing services.

In the event that the Company has provided services to you and/or your company but subsequently discovers that you and/or your company fall under one of the categories for which the Company refuses to provide services as mentioned above, the Company will proceed at its discretion:

  1. Terminate service and notify the Customer.

  2. Remove all job postings (if any).

  3. Remove or disable your Joblink website account if deemed necessary.

  4. We will refund any amount you have paid (if any) corresponding to the volume of services that the Company has not yet provided and/or that you have not yet activated.

Ordering and Payment Services

  1. You can purchase one or more services available in Joblink's Service List through an Order and/or Service Agreement.

    If the Customer purchased the Job Posting Service:

    • Job postings will be displayed on the Joblink website for 30 (thirty) days from the date of activation. The job title cannot be changed after the job posting has been activated and displayed on the Joblink website.

    • Each job posting may include only 01 (one) job title along with 01 (one) job description and job requirements.

    If the Customer purchased the service is Profile Search:

    • Customers will be provided with credit points corresponding to the service package they purchase.

    • When you activate the Profile Search service package and select to view profile details – candidate information, the credit points for the corresponding service package will be deducted as follows:

      • i) Scoring structure for Clients not operating in the employment services sector:

        • One point will be awarded for each recent graduate's application.

        • 2 points will be awarded for each experience profile.

        • 3 points will be awarded for each application with a rank of department head or higher.

        • 10 points will be awarded to each applicant demonstrating intermediate or higher Japanese language proficiency (regardless of experience).

      • ii) The scoring structure for Clients operating in the employment services sector, except for Clients falling under point (iii) below:

        • 5 points will be awarded for each recent graduate or experienced profile.

        • 10 points will be awarded for each department head-level profile.

        • 20 points will be awarded for each application at the director level or higher.

        • 10 points will be awarded to each applicant demonstrating intermediate or higher Japanese language proficiency (regardless of experience).

      • iii) Scoring structure for clients operating in the employment services sector who are Japanese or Korean companies:

        • 10 points for each application.

  2. Joblink's services are available with upfront or post-payment via cash, bank transfer, or credit card. A list of accepted credit cards will be published on the Joblink website. Service fees must be paid no later than the Payment Date specified in the Order.

    If the Customer fails to pay the Service Fee by the Payment Date, the Company reserves the right to suspend service until full payment is received.

  3. The company will issue a VAT invoice in accordance with current Vietnamese law upon customer request. Customers are responsible for the accuracy of the information provided on the VAT invoice.

Terms of Service

  1. After you have paid the Service Fee and/or activated the purchased Services, we will not accept any requests to suspend or cancel the purchased Services, or to refund the Service Fee, or to change the services.

  2. You will create your own account and password to use the services on the Joblink website.

  3. You are entitled to post your job posting content and/or links on the Joblink website to your job posting content on your website and are solely responsible for the accuracy and legality of this content. However, you are not permitted to include any email address and/or telephone number and/or fax number or any other form of contact information in your job posting content.

  4. You must activate the purchased Service within the validity period. Once the validity period expires, any purchased but unactivated Service will no longer be available.

  5. In the event that, due to our intentional fault, we fail to rectify the violation within 7 (seven) working days from the date you provide written notice of the violation, we will refund you the Service Fee corresponding to the unused Service under the Order/Service Contract that we did not provide as agreed upon between the two parties.

Rights and Responsibilities of Users

Accessing the Joblink.vn website. You are responsible for providing all hardware, software, telephone number or other communication devices and/or internet connection services to access the Joblink.vn website, and you are responsible for paying all internet access fees, telephone charges, or other fees incurred during the process of connecting to the internet and accessing the Joblink website.

User Ethics. By using Joblink's Services and accessing the Joblink Website, you are fully aware of the following prohibitions:

  1. Opposing the Socialist Republic of Vietnam, undermining national unity, spreading propaganda, distorting facts, inciting unrest, or providing information that undermines the Vietnamese State;

  2. Inciting violence, propagating wars of aggression, sowing hatred between nations and peoples, inciting obscenity, depravity, crime, social evils, superstition, and undermining the traditional customs and values ​​of the nation;

  3. Disclosing state secrets, military secrets, security secrets, economic secrets, foreign relations secrets, and other secrets as stipulated by law;

  4. Distorting facts, making false accusations, and insulting the reputation of organizations, as well as the honor, dignity, and reputation of citizens;

  5. Advertising and promoting goods and services that are on the list of prohibited items as stipulated by law;

  6. Addressing political and religious issues;

  7. Using vulgar language violates Vietnamese moral traditions;

  8. Restricting or preventing other users from using and enjoying interactive features;

  9. Sending or transmitting illegal, threatening, abusive, defamatory, libelous, pornographic, aesthetically offensive, offensive, or any other indecent information, including but not limited to disseminating information that contributes to or encourages criminal behavior, causes civil liability, or violates local, federal, national, or international law;

  10. Sending or transmitting any information, software, or other materials that infringe upon or violate the rights of others, including materials that infringe upon privacy or publicity rights, or materials protected by copyright, trademark or other proprietary rights, or derivative products, without the permission of the owner or legally entitled person;

  11. Sending or transferring any information, software, or documents containing a virus or other harmful component;

  12. Altering, damaging, or deleting any content or other media that is not your property, or interfering with others' access to the Joblink Website;

  13. Disrupting the normal flow of information within an interactive area;

  14. Making a statement that is affiliated with or speaks on behalf of any business, association, institution, or organization with which you are not authorized to make such a statement;

  15. Carrying out cyberattacks, cyberterrorism, cyberespionage, and cybercrime; causing incidents, attacks, intrusions, taking control, falsifying, disrupting, halting, paralyzing, or destroying information systems;

  16. Using the Joblink website for illegal purposes, including but not limited to violating any rule, policy, or usage guideline of your internet service provider or online services.

Mass and Automated Account Registration. Accounts registered automatically and/or systematically in large numbers, at the Company's sole discretion, are considered a violation and will be subject to penalties as stipulated in these Terms and Conditions.

Non-proper use. Any misuse and/or unauthorized use of the Joblink website for purposes other than recruitment and job searching, at the sole discretion of the Company, may be considered a violation and will be subject to penalties as stipulated in these Terms and Conditions.

Harassing other users. The company aims to create a free and healthy environment for recruitment and job searching activities for all users. When using the Joblink website, you need to carefully consider the content you post in the interactive area and your responses to other users. If the company receives reports of any harassing behavior (including but not limited to threatening behavior, posting empty content or random strings of characters/words that are meaningless and/or unrelated to reasonable interactive content, sending spam, using deceptive methods to attract attention or for commercial marketing purposes) that affects the use of the service, hinders access to information, or causes discomfort to other users, the company has the right to immediately suspend service without notice and/or refund the money to the reported user for investigation and handling in accordance with these Terms and Conditions.

Requiring applicants to pay fees is prohibited. The company does not collect fees from applicants. Collecting fees from applicants is strictly prohibited under current Vietnamese law. You will strictly adhere to these regulations. In specific cases where applicants are required to pay for goods/services to you, your company, or any other legally permitted third party (such as immigration fees to work in another country, work permit fees, vocational training fees, etc.) in order to be hired and work for you and/or your company, information about these fees must be disclosed in the job posting.

If the Company discovers or receives reports from other users about any payment requests relating to you and/or your Company that are inconsistent with the above regulations, the Company has the right to immediately suspend the provision of the relevant service without notice and/or refund you in order to investigate and handle the violation in accordance with these Terms and Conditions.

In the event that any user requests payment of any amount related to your application or employment with them, you must use your best judgment to thoroughly investigate and evaluate all information and carefully consider all factors before deciding to pay. The company will not be liable for any damages, risks, or losses of any kind that users may incur as a result of making decisions related to interacting with other users, whether through the Joblink website or not.

Report violations. If you believe that the conduct of any other user is inconsistent with the provisions of these Terms and Conditions, you can always notify us for review.

Interaction Zones

You acknowledge that the Joblink website may contain various interactive areas, including but not limited to jobs. These interactive areas allow for feedback to the Joblink website and real-time interaction between users. You also understand that the Joblink website does not control the messages, information, or files distributed to such interactive areas and that the Joblink website may give you and other users the ability to create and manage an interactive area. However, the Joblink website, its parent company, or its subsidiaries, as well as their respective directors, employees, contractors, and agents, are not responsible for the content in any interactive area.

Your use and/or management of an interactive area will be governed by this Agreement and any additional rules, or by the operating procedures of any interactive area established by you or other users. You acknowledge that the Joblink Website cannot and does not intend to pre-screen information. Furthermore, because the Joblink Website encourages open and unbiased communication in interactive areas, it cannot pre-determine the accuracy or appropriateness of any content transmitted within an interactive area in relation to this Agreement. The Joblink Website is not responsible for pre-screening, policy-making, editing, reviewing, or monitoring any content within an interactive area.

However, you also agree that the Joblink Website has the right to monitor all interactive areas, sometimes disclosing certain information if necessary as required by law, or other government requirements regarding the operation of the interactive area, or to protect itself or other users. If notified that the content posted is inconsistent with this Agreement, the Joblink Website may carefully investigate and determine whether to remove or request the user to remove that content. The Joblink website reserves the right to prohibit actions, communication of news or content within the interactive area, or to draft, refuse to send, or remove any content, in whole or in part, which, in our best interest, we deem to (i) violate the then-current standard terms of this Agreement or any other standard in Joblink.vn's policy that is in effect at that time, (ii) be detrimental to the rights of all users, the Joblink website, or other third parties, (iii) violate applicable law, or (iv) otherwise be unfavorable.

Intellectual Property Rights

Joblink.vn Career Website Content. You acknowledge that the Joblink Website allows access to copyrighted content, trademarks, and other proprietary rights (including intellectual property rights) (“Intellectual Property Rights”), and acknowledge that such intellectual property rights are valid and protected across all existing and future media, except as expressly stated below, your use of the content will be governed by applicable copyright and other intellectual property laws.

You agree and acknowledge that all content on the Joblink Website, including but not limited to resumes, is the sole intellectual property of the Joblink Website and Joblink, and that you are not permitted to alter, copy, reproduce, transmit, distribute, publish, create derivative works, display or transfer, or exploit for commercial purposes any part of the content, in whole or in part. However, you may (i) make a digital or other copy so that your computer hardware and software can access and view the content, (ii) print a copy of each section of the content, and (iii) create and distribute a reasonable number of copies of the content, in whole or in part, in print or electronic form for internal use.

Any permitted copies of the content must reproduce in an immutable form any notices contained in the content, such as all Intellectual Property notices, and the original sources for the “Joblink.vn career website” and its web address (URL). You will not acquire any Intellectual Property Rights through downloading or printing the content. Any unauthorized copies or use of the content for commercial purposes will be considered a violation and will be dealt with according to the relevant provisions of law and the terms of this agreement.

User-provided content. You may only upload to any interactive area or transmit, send, publish, simulate, or distribute on or through the Joblink Website any content that is not subject to any Intellectual Property Rights, or content for which the holder of the Intellectual Property Rights has expressly authorized its distribution on the Internet and on the Joblink Website without restriction. Any content provided with the consent of the copyright holder other than you must include a statement such as “copyright owned by [name of copyright holder]; used under authorization”. By posting content to any interactive area, you automatically accept and/or warrant that the owner of that content, either you or a third party, has granted the Joblink Website a royalty-free, perpetual, immutable, non-exclusive, and unrestricted right and license to use, reproduce, modify, adapt, publish, translate, create derivative works, sublicense, distribute, perform, and display that content, in whole or in part, worldwide and/or in combination with other works in any form, through current or future media or technologies, in full terms of any Intellectual Property Rights in that content. You also grant the Joblink Website unlimited sublicense rights to third parties to exercise any of the above rights with respect to that content. You also allow the Joblink Website to use your company name and logo for marketing purposes.

Links, Disclaimers, Limitations of Liability

Links. You understand that, except for the content, products and services on the Joblink Website, Joblink.vn, its parent company, or its subsidiaries, as well as their respective directors, employees, contractors and agents, are not responsible for the content, goods or services of other sites on the Internet linked to or from the Joblink Website. All such content, goods and services are accessible on the Internet by independent third parties and are not part of the Joblink Website or controlled by Joblink.vn. The Joblink Website does not endorse and is not responsible for the accuracy, completeness, usefulness, quality and availability of any content, goods or services on sites linked to or from the Joblink Website; that is the sole responsibility of those independent third parties, and therefore your use is at your own risk. The Joblink website, its parent company, or its subsidiaries, or their respective directors, employees, contractors, and agents, are not liable, directly or indirectly, for any loss or damage caused by or alleged to be caused by your use of or reliance on any content, goods, or services on any site connected to or from the Joblink website, or due to your inability to access the Internet or any site connected to or from the Joblink website.

Disclaimer of warranties. Please use your best judgment in evaluating all information or opinions presented on the Joblink Website. The Joblink Website policy does not endorse or refute any user-expressed opinions or content provided by independent groups. YOU EXPRESSLY AGREE THAT YOUR USE OF THE JOBLINK WEBSITE IS AT YOUR OWN RISK. Joblink Website, AND ITS PARENTAL COMPANY, OR ITS AGENCY, OR ITS DIRECTORS, EMPLOYEES, EMPLOYEES, AGENTS, PARTNERS, MEMBERS, LICENSORS, OR OTHER PROVIDERS OF CONTENT, DATA, INFORMATION, OR SERVICES, DO NOT GUARANTEE THAT Joblink Website OR ANY INTERNET SITE CONNECTED TO OR FROM Joblink Website WILL BE FREE FROM INTERRUPTIONS OR ERRORS, THAT THERE WILL BE NO DEFECTS. WILL BE REPAIRED, OR THIS SITE, INCLUDING INTERACTIVE AREAS OR THE SERVER THAT CREATED IT, WILL NOT BE INFECTED WITH VIRUSES OR OTHER HARMFUL COMPONENTS. AND WE DO NOT GUARANTEE THE RESULTS OBTAINED FROM USING THE Joblink Website OR THE TIMELINESS, SEQUENCE, ACCURACY, AUTHORITY, COMPLETENESS, USEFULNESS, INVIOLABILITY, RELIABILITY, AVAILABILITY, OR CERTAINTY OF ANY CONTENT, INFORMATION, SERVICES, OR TRANSACTIONS PROVIDED THROUGH THE JOBLINK WEBSITE OR ANY SITE CONNECTED TO OR FROM Joblink Website. Joblink Website IS PROVIDED ON AN “AS IS” OR “IF ANY” BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

Limitations of legal liability. IN NO EVENT, Joblink Website, its parent company, or its subsidiaries, or their directors, employees, subcontractors, agents, associates, or licensors shall be liable for any incidental, special, or incidental damages arising from or due to this agreement, Joblink Website, or any internet site connected to or from Joblink Website, for any reason whatsoever. BREACH OF CONTRACT, MISCONDUCT, NEGLIGENCE, OR ANY OTHER CAUSE OF ACTION, INCLUDING BUT NOT LIMITED TO ANY LIABILITY FOR ANY DAMAGES CAUSED BY OR ALLEGEDLY CAUSED BY ANY LACK OF PERFORMANCE, MISSION, INTERRUPTION, POWER OUTAGES/DAMAGES/INTERFERENCE, DELETION, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUSES, COMMUNICATION FAILURES, EQUIPMENT FAILURES, SOFTWARE ERRORS, VIOLATIONS, UNAUTHORIZED ACCESS, OR THEFT, DAMAGE, REPLACEMENT, OR USE OF RECORDS.

IN NO EVENT, the Joblink Website, its parent company, or its subsidiaries, or its directors, employees, subcontractors, agents, associates, or licensors shall not be liable to you or any other third parties for any decisions made or actions taken by you based on belief in the content contained on the Joblink Website or its content within any internet site. CONNECTED TO OR FROM the Joblink Website. CONTENT WITHIN the Joblink Website AND CONTENT WITHIN INTERNET SITES CONNECTED TO OR FROM the Joblink Website MAY CONTAIN TECHNICAL ERRORS, OTHER INACCURACIES, OR PRINTING ERRORS.

YOU EXPRESSLY AGREE AND ACKNOWLEDGE THAT the Joblink Website is NOT LEGALLY RESPONSIBLE FOR ANY DEFAMATION, ATTACKS, DISHONESTY, OR OTHER ILLEGAL ACTIONS BY ANY USER. IF YOU ARE NOT SATISFIED WITH ANY CONTENT OF THE Joblink Website, OR WITH THE JOBLINK WEBSITE ACCESS AGREEMENT, IN WHOLE OR IN PART, YOUR SOLE REMEDY IS TO CEASED USE OF THE JOBLINK WEBSITE.

Compliance and Violation Handling

You must comply with the regulations in the Order, Service Agreement, and these Terms & Conditions as a prerequisite for using the Service. If you violate any of the regulations in the Order, Service Agreement, and these Terms & Conditions, we have the right to remove all your job postings, content, or links, or to remove, disable, or suspend your Joblink website account if deemed necessary, and to temporarily suspend and/or terminate the provision of services without refunding the Service Fee or any unused service fees. We also have the right to claim compensation for any damages or losses arising from your violation.

Compensation

You agree to pay and indemnify Joblink Website, its parent or subsidiary companies and affiliates, directors, employees, contractors and agents from all liability, claims and costs, including reasonable attorney fees, arising from a breach of this Agreement, from any other policy, from your use of or access to Joblink Website or internet sites linked to or from Joblink Website, or from the transmission of any content on Joblink Website.

Security

You agree to the confidentiality of information relating to the Service, the execution of transactions, and/or any other information collected from the execution of transactions. You will cooperate in preventing and combating the unauthorized copying and use of your job postings or other information on the Internet by any third party.

You may not disclose, share, or sell candidate information collected through the use of the service to any third party in any form without the prior written consent of the Company.

Furthermore, the Client is responsible for maintaining the security of their account and password, and for using the account solely for their recruitment purposes as stipulated in the Purchase Order/Service Contract.

Payment security mechanism

  1. Payments on the Joblink platform are processed through the One Pay payment gateway payment partner (or other payment partners as selected by Joblink from time to time).

  2. Joblink does not store customer payment information. Customer payment information will be processed by Joblink's payment partners. In addition, to ensure the safety and security of connections with OnePay and internally stored transaction data, we apply:

    • Secure 24/7 connectivity via HTTPS/TLS protocol.

    • System access control and authorization.

    • Regularly back up your transaction data.

    • Monitoring, alerting, and protecting the system using an application firewall.

  3. All card payment transactions are verified through the Payment Gateway. The verification process is automated using computer algorithms, ensuring that customer payment information is completely secure and confidential. However, in some cases where the system cannot verify the information, a representative from the card-issuing bank may contact the customer to request additional information to confirm the transaction. A payment transaction is considered successfully verified when the information provided by the customer matches the information from the system.

Other Issues

This agreement constitutes the entire agreement between the Joblink Website and you, and supersedes all prior agreements on this subject. The Joblink Website may modify this Agreement or any other policy at any time and from time to time, and such modifications will be immediately effective upon notice of such modifications being posted in a prominent place on the Joblink Website.

You agree to review this Agreement periodically to become aware of any modifications. If you do not accept these modifications, you must cease accessing the Joblink Website. Your continued access and use of the Joblink Website after notification of any such modifications will be deemed acceptance of all such modifications.

If any provision of this Agreement or of any other policy becomes invalid or unenforceable, that provision shall be interpreted in accordance with the most applicable law that is applicable to reflect the original intent of the parties, and the remainder shall continue in full force and effect. Joblink Website's inability to enforce or enforce any provision of this Agreement shall not be deemed a waiver of any provision or right. This Agreement shall be governed by the laws of the state or province where Joblink Website is located, unless there is a conflict of laws, and you and Joblink Website are subject to the exclusive jurisdiction of the courts of that state or province.

This Agreement is exclusive to you and you may not transfer your rights or obligations to anyone else. All logos, affiliate names, products, trade names, or service marks appearing herein may be the trade names or service marks of their respective owners. References to any trade names, service marks, and links to or from the Joblink Website are made strictly for clarification and identification purposes and do not constitute an endorsement by the Joblink Website of the products, services, or information offered by the owner of the trade name, service mark, or link, or an endorsement by the owner of the Joblink Website.
