Joblink Company (“Joblink”) informs you and requires your consent and permission to process, collect, and store your data for the purpose of providing services to you throughout your use of the Joblink Website and Mobile Application (hereinafter collectively referred to as the “Joblink Platform”) as in this Privacy Policy. Joblink is committed to complying with and keeping your information private and secure in accordance with the law. By choosing to confirm and agree to the Privacy Policy when registering an account, you allow us to collect, use, disclose, and/or process your personal data as set out in this Policy. This permission will be effective from the time you agree until you decide to withdraw your consent or automatically terminate in cases as prescribed by law. If you do not agree to allow the processing of your data under these terms, please do not use our services or access our platform, or notify us immediately of your disagreement if you previously agreed.

Our Joblink platform may contain links to other websites that we do not control. Joblink, the company that owns and operates the Joblink platform, is not responsible for the privacy policies or their implementation by other websites that you link to from the Joblink platform. We encourage you to review the privacy policies of those other websites to understand how they collect, use, and share your information.

What personal data is collected from you?

The Joblink platform, to the extent appropriate to its purpose of providing services to you and subject to your sole discretion, will collect personal data in a number of ways from various sources on its platform. This includes the following information:

1. Surname, middle name, given name, and other names (if any);

2. Date of birth (day, month, year);

3. Gender;

4. Information about residence (including permanent residence, temporary residence, current address, place of birth, contact address);

5. Nationality;

6. Personal photos;

7. Phone number, national identity card number, personal identification number, passport number;

8. Marital status;

9. Information about family relationships (parents, children);

10. Email address;

11. Information about educational and work history (including references);

12. Payment information, such as bank account numbers, credit card numbers, and any other payment details;

13. Account information, such as user ID and password, your account usage history, details of products or services you have purchased or acquired on the Joblink platform;

14. Technical information and web data such as your Internet Protocol (IP) address, your login data, browser type and version, time zone and location settings, browser plugin types and versions, operating system and platform, international mobile device version, device identifier, how you use and view any content on the Joblink Platform, and other information and technologies on the devices you use to access this platform;

15. Any data or other information that you proactively provide through our platform during the use of the service.

And some sensitive personal data includes:

16. Your voice during recorded calls (if any);

17. Health information in medical examination reports and information in criminal record reports provided by you (if any);

18. Information about your income level (if any); and

19. Information about your ethnicity, religion, and political party affiliation (if any).

If you choose to register/link your account on the Joblink Platform with your other social media accounts, you authorize us to access, collect, and process your personal data that you have voluntarily provided to social media account providers in accordance with their policies, and we will manage and use this personal data in accordance with this Privacy Policy at all times.

If you provide us with the personal data of any third party, you represent and warrant that you have obtained the necessary consent, license, and permission from that third party to share and transfer their personal data to us and for us to collect, store, use, disclose, and/or process that data in accordance with this Policy. You must submit to us legal documentation proving that you have obtained such consent and permission.

Purpose of Collection, Use, and Disclosure

Depending on your relationship with us, the personal data we collect from you may be collected, used, and disclosed for the following (not exhaustive) purposes:

1. To verify your identity and to manage any online accounts you may have set up with us;

2. To provide you with services, specifically those related to job searching and recruitment, we may publicly disclose your personal data on the Joblink Platform at your discretion, as well as transfer your personal data to third parties, including employers who may be your future employers or employees;

3. To process orders you submit through the Joblink Platform (including any payments you make through the Joblink Platform for products, whether sold by us or any of our affiliates);

4. To verify and process online financial transactions involving payments, and to identify you for anti-money laundering, reporting suspicious transactions, and fraud detection purposes;

5. Contacting you to process and respond to your queries, feedback, complaints, or disputes, whether directly or through any externally hired customer service provider;

6. To inform you about products and services offered by the Joblink Platform or its partner companies, or to solicit your feedback on current or potential new products and services.

7. To send you promotional/advertising materials from any of our affiliates, whether directly or through any of our advertising and strategic partners;

8. To improve this Joblink Platform; to improve the services and products sold;

9. To conduct market research on demographics, preferences, and advertising or purchasing and other user behaviors;

10. To provide you with information that we believe you may find useful or that you have requested from us, including information about our products and services or those of our affiliates, provided that you do not express objection when contacted for such purposes;

11. Comply with court orders or other legal proceedings or other legal and/or regulatory requirements of any government agency and/or regulatory body; and

12. Any purpose described to you at the time of collecting your personal data.

What are cookies and how are they used?

As part of providing personalized and on-demand services, the Joblink Platform may use cookies to store and sometimes track information about you. Cookies are small pieces of data sent to your browser from a web server and stored on your computer's hard drive. Some features of the Joblink Platform require your acceptance of cookies in order to be usable. (See “ Your Choices ” for more details about cookies).

In general, we use cookies for the following purposes:

(1) Identify and label all “new” jobs since your last visit to the website.

(2) Save your username and password on your computer as needed or permanently so you don't have to re-enter them every time you visit our website.

(3) Allows you to “checklist” the tasks you want to mark to keep and view later.

The advertising networks of companies posting jobs on the Joblink Platform may also use their own cookies.

The Joblink platform will also collect and may collect certain information about your use of the Joblink platform, such as the areas you visit and the services you access. In addition, the Joblink platform may collect information about the hardware and software on your computer. This information may include, but is not limited to, your IP address, browser type, domain name, items you access, and referenced websites.

How is your data processed?

Your data will be stored and processed, in whole or in part, in Vietnam. If you access the Joblink Platform from a location outside of Vietnam, such use is understood to mean that you agree to transfer your data outside that country/territory and to Vietnam. Your personal information and/or data may be transferred overseas, stored, or processed outside your country for one or more purposes. Joblink will only transfer your personal data overseas when it is in compliance with the laws and regulations on personal data protection.

By providing your information, you agree that Joblink Website, its affiliated companies, subsidiaries, and members may use your information in accordance with the purposes stated above and applicable laws.

We may also use your contact information to send you emails or other notifications about updates on the Joblink Platform. The content and frequency of these notifications will vary depending on the information we have about you. You have the option to receive information, notifications, and promotions, including but not limited to free newsletters from the Joblink Platform related to topics that may be of particular interest to you.

By choosing to share and disclose personal data on Joblink's recruitment website, you agree to and authorize Joblink to share that information on the Joblink Platform, unless otherwise specifically stated. However, some activities, due to their nature, may require the personal information you share to be collected by other users of the Joblink Platform, such as employers. In such cases, separate agreements regarding the collection of personal data will be required between you and the third parties collecting the information, and Joblink, acting as an intermediary platform, under no circumstances makes any warranties or assumes any liability to either party.

Who might share your data with?

We do not disclose your personal information, or combined personal and demographic information, or information about your use of the Joblink Platform (such as the regions you visit, or the services you access) to third parties, except in the following cases.

1. We may disclose such information to third parties if you consent. For example, if you indicate that you wish to receive information about job postings or third-party products and services when registering an account on the Joblink Platform, we may provide your contact information to that third party, e.g., sending Job Seeker data to Employers, data collectors, or others for the purpose of emailing you or contacting you in other ways. We may use existing data about you (such as your stated interests or preferences) to determine whether you might be interested in the products or services of a particular third party.

Joblink may send Job Seeker's Personal Data to Employers, including when doing so at the instruction of both the Job Seeker and the Employers. Such data transmission occurs during the recruitment, job search, application, and interview processes. Job Seeker's Personal Data transmitted to Employers in this manner is processed in accordance with Joblink's Privacy Policy and the relevant employer's personal data protection policies. This data transmission may include sending your application and/or additional applicant information, such as your contact details, to other platforms that process Job Seeker's Personal Data for Employers, such as Application Tracking Systems (ATS) or other platforms of the employer's choice. If you are the Employer, you agree to comply with all responsibilities of the Personal Data Controller and/or the Personal Data Processing and Control Party in accordance with your personal data protection policies consistent with applicable data protection rules regarding the collection, processing, and storage of Personal Data, and to provide full protection for all data subject rights provided under all applicable data protection rules.

2. We may disclose such information to companies and individuals we hire to perform company functions on our behalf. For example, maintaining web servers, analyzing data, providing marketing assistance, processing credit card or other forms of payment, and customer service. These companies and individuals will access your personal information as needed to perform their functions, but will not share it with any other third parties.

3. We may disclose such information if legally required, or by a government agency, or if we believe such action is necessary to: (a) comply with legal requirements or process; (b) protect the rights or property of Joblink or its partners; (c) prevent crime or protect national security; or (d) protect the personal safety of users or the public.

4. We may disclose and transfer such information to a third party acquiring all or a majority of Joblink's business through a combination, consolidation, or acquisition of all or a majority of our assets. Furthermore, in the event Joblink becomes subject to bankruptcy proceedings, whether voluntary or involuntary, Joblink or its trustee may sell, permit, or otherwise disclose such information in a manner agreed upon by the bankruptcy court.

5. We may use your name, your company name or logo, or other information about or from your job postings or candidate profile viewing account for any or all of Joblink's (or Joblink Platform's) marketing purposes. For example, company names or logos may be used in newspaper advertisements, direct mail, sales materials, posters, and other materials related to the Joblink Platform or other Joblink assets.

Joblink may also share deunidentified information about visitors to one of the company's websites (for example, the number of visitors to the 'Job Search' section of the Joblink Platform) with customers, partners, and other third parties so they can understand the types of visitors to the Joblink Platform website and how they use the site.

Joblink may provide technology, web hosting, and other related services to other leading companies to set up job postings on non-our websites (sometimes referred to as “recruitment areas”). Personal information you provide in these recruitment areas becomes part of the Joblink Platform database, but no one except you, Joblink, and the related company can access it without your consent.

Information collected on recruitment sites or on brand-sharing sites (such as a page about a contest co-sponsored by the Joblink Platform and another company) may become the property of that company, or of both Joblink and that company. In this example, the other company's use of such information may depend on the agreement between you and that company and, in any case, Joblink is not responsible for the other company's use of your personal data.

Your choices

If you choose not to register or provide personal information, you will not be able to use most of the Joblink Platform.

You also have options regarding cookies. By changing your browser preferences, you can choose to accept all cookies, be notified when a cookie is set, or reject all cookies. If you choose to reject all cookies, you will not be able to use Joblink Platform services that require registration. These services include identifying new jobs posted since your last visit, automatic login, and listing checking. You can still use most Joblink platform features even if you do not accept cookies.

How can you access, update, and delete your information?

We will provide you with the means to ensure your personal information is accurate and up-to-date. You can edit or delete your profile at any time by clicking the “My profile” link or the system-provided image when you log in. Once logged into the system, regardless of your location on the Joblink recruitment platform, your information will remain intact until you click the “Logoff” link, which is accessible from the “My Profile” screen.

If you are a registered user and have forgotten your password, you can retrieve it by email and using the “Forgot Password” feature. Press the button on any login page to request that your password be sent to you. We cannot provide your password in any other way.

Your Joblink Platform account may be deleted, but doing so will result in the inability to access any features that require login. We will, or may, keep an archived backup of your account upon request.

Risks and safety measures

Always remember that whenever you voluntarily disclose and make your personal information public on the internet, that information may be collected and used by others for purposes beyond your and our control.

Aside from the Joblink Platform administrator or other authorized individuals of the Joblink Platform, you are the only one who has access to your personal information. Your registration is password-protected to prevent unauthorized access.

Ultimately, you are solely responsible for keeping your password and/or any account information confidential. Therefore, please be careful and responsible in your online activities. We recommend that you do not disclose your password to anyone. The Joblink platform will never ask for your password by phone or email without permission. For security reasons, you may want to log out immediately after using the Joblink platform. This ensures that others cannot access your personal information and correspondence if you share a computer with someone or use a computer in a public place such as a library or internet cafe.

Unfortunately, no data transmitted over the Internet can be guaranteed 100% secure. Therefore, although we do our best to protect your personal information in accordance with the law by taking all necessary technical and legal measures, the Joblink Platform cannot guarantee or promise the security of any information you transmit to us or from our online services, and you do so at your own risk. As soon as we receive the information you submit, we will do our best to secure it on our systems.

How the Joblink platform protects children's privacy.

User age is mandatory information you must provide to us. Children must obtain permission from their parents or guardians before submitting personal information online to anyone. The Joblink platform cannot collect and share personal information about users under 13 years of age with third parties. Additionally, the Joblink platform will not send any direct emails requesting users to notify that they are under 13 years old.

Withdraw consent

You may, at any time, notify us of your withdrawal of consent to the continued use, disclosure, storage, and/or processing of your personal data for any of the purposes outlined above by contacting us. We will respond to your request as soon as possible to confirm your withdrawal of consent.

Please note that if you withdraw your consent to our use, disclosure, storage, or processing of your personal data for the purposes stated above, we may cease providing services to you or performing any contractual obligations with you, and we will not be liable in the event that we fail to provide services or perform our contractual obligations with you. In such a case, our legal rights and remedies will expressly remain reserved.

Changes to the Privacy Policy

We reserve the right to change or update these Privacy Policy at any time, provided that such updates or changes do not violate applicable laws. Any changes or updates will be notified to all users on our Platform.
